Terms of Service

The rules for using our website and products, written to be read rather than skimmed. Last updated 17 September 2026.

01The agreement

These terms are a contract between you and Olvix ("Olvix", "we", "us"), a software business based in South Africa. They apply to olvix.co.za, to the software products and hosted tools we operate (the "Service"), and to any order form or plan you accept for a paid product.

By using the Service you accept these terms. If you are accepting on behalf of a business, you confirm you have the authority to bind it. If you do not agree, do not use the Service.

  • "Customer" means a business that has an account with us, including the people it authorises to use that account.
  • "End User" means a person who books, pays, joins a queue or receives messages from a Customer through the Service.
  • Our Privacy Policy explains how personal information is handled and forms part of these terms.

02Accounts and eligibility

  • You must be at least 18 years old and able to enter into a contract to create an account.
  • Keep your login details confidential and tell us promptly if you suspect unauthorised access. You are responsible for activity under your account, including by staff you add to it.
  • Give us accurate information and keep it current: business name, contact details, opening hours, prices and policies shown to End Users must be true.
  • One business per account unless we agree otherwise. Accounts may not be sold or transferred without our written consent.

03The Service

We provide hosted software, such as online booking, walk-in queues, deposits, reminders and customer messaging, together with the support described in your plan. We may add, change or retire features over time. Where a change materially reduces what you are paying for, we will give you reasonable notice and the option to cancel.

We aim to keep the Service available at all times but cannot promise uninterrupted operation. Planned maintenance is scheduled outside busy hours where possible and announced in advance when it affects you.

04Plans, fees and billing

  • Paid plans are billed monthly in advance in South African rand unless your plan says otherwise. Prices exclude VAT where applicable.
  • Plans include a monthly allowance of messages (for example WhatsApp conversations). Usage beyond the allowance is charged at the top-up rates shown in the Service or in your plan.
  • Trials are free for the stated period. When a trial ends, the account continues on the plan you chose only if you have added a payment method.
  • Fees are non-refundable except where these terms or the law say otherwise. If a payment fails we will notify you and may suspend the account after a reasonable grace period.
  • We may change prices with at least 30 days' notice. Continuing to use the Service after the change takes effect means you accept the new price.

05Payments and deposits

Deposits and payments from End Users are processed by third-party payment providers such as Paystack and settle to the Customer's own merchant or bank account. Olvix does not hold client funds and is not a party to the transaction between a Customer and its End Users.

  • Customers must comply with their payment provider's terms and are responsible for their own refunds, chargebacks and disputes.
  • Refund and cancellation outcomes shown to End Users follow the policy the Customer configures in the Service. Customers must make sure that policy is lawful and clearly displayed.
  • Payment-processing fees are set by the provider and are the Customer's responsibility unless your plan says we absorb them.

06Messaging on WhatsApp, SMS and email

The Service can send messages to End Users on a Customer's behalf through channels such as the WhatsApp Business Platform, SMS and email. When you use these features you agree that:

  • You will only message people who have opted in, and you will honour opt-outs (including STOP replies) immediately. The Service records consent and enforces opt-outs; you may not circumvent this.
  • You will comply with the WhatsApp Business Messaging Policy, the WhatsApp Business Terms of Service and any equivalent rules for other channels, including restrictions on prohibited content and industries.
  • You will not send unsolicited marketing, misleading content, or anything unlawful, and you will not use message templates for a purpose other than the one they were approved for.
  • Message delivery depends on third-party networks. We are not responsible for delays or failures outside our control, but we will show you delivery status where the provider reports it.
  • Channel providers may suspend numbers or accounts for policy breaches. If a breach on your account causes that, we may pass on the consequences to you, including suspension.

07Acceptable use

You may not use the Service to:

  • Break the law, infringe anyone's rights, or process personal information without a lawful basis.
  • Send spam, harassing or deceptive messages, or impersonate another person or business.
  • Probe, scrape, overload or interfere with the Service or its infrastructure, or attempt to access other Customers' data.
  • Resell or sublicense the Service, or build a competing product using it.
  • Upload malware or content that is unlawful, defamatory or hateful.

We may remove content and suspend or terminate accounts that breach this section.

08Your content and data

Customers own the data they put into the Service, including their client lists, bookings and message history. You grant us a licence to host, process, back up and display that data only as needed to provide the Service, support you, and meet our legal obligations.

  • We act as an operator (processor) for personal information you collect about End Users and process it only on your instructions and under our Privacy Policy. You are the responsible party (controller) for that data and must have a lawful basis to collect it.
  • You are responsible for the accuracy and legality of the content you publish, such as prices, descriptions and policies.
  • You can export your data at any time through the Service or by asking us. After termination we delete or de-identify Customer data within a reasonable period, except where we must keep records by law.
  • We may use aggregated, de-identified usage information to improve the Service.

09Bookings and services provided by Customers

If you are an End User booking with, paying, or receiving messages from a business through the Service, your contract for that appointment or service is with the business, not with Olvix. The business sets its own prices, deposits, cancellation windows and refund rules, which are shown to you before you confirm.

  • Olvix provides the platform in good faith but does not guarantee the quality, safety or availability of a business's services.
  • Questions about an appointment, a refund or a deposit go to the business first. We will help the business respond, and you can contact us if you cannot reach them.
  • By booking you agree to receive transactional messages about that booking (confirmations, reminders, changes). Marketing messages need your separate consent, and you can opt out at any time.
  • You must provide accurate details and treat staff and other customers with respect. Businesses may decline or cancel bookings in line with their policies.

10Intellectual property

The Service, including its software, design, documentation and trade marks, belongs to Olvix or our licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your business during your subscription. You may not copy, modify, reverse engineer or create derivative works from it, except where the law allows.

If you give us feedback or suggestions, we may use them without any obligation to you.

11Third-party services

The Service relies on third parties such as Meta (WhatsApp Business Platform), payment providers, email and SMS gateways, calendar providers and hosting. Their terms apply to your use of their features through the Service. We are not responsible for their acts or omissions, and changes they make may affect what the Service can do.

12Support, availability and changes

  • Support is provided by email and, on eligible plans, by WhatsApp during business hours. Response times depend on your plan and the severity of the issue.
  • We back up Customer data regularly and test restores. Backups are a safety net, not a substitute for your own records.
  • We may update these terms. Material changes take effect at least 30 days after we notify you through the Service or by email, or immediately where required by law. Continued use after that date means you accept the new terms.

13Warranties and disclaimers

We will provide the Service with reasonable skill and care. Otherwise, to the extent the law allows, the Service is provided "as is" and we make no other warranties, express or implied, including about fitness for a particular purpose, uninterrupted or error-free operation, or the results you will get from using it. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be excluded.

14Limitation of liability

  • To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, revenue, business or goodwill, or loss of data that you could have prevented by exporting it, arising from your use of the Service.
  • Our total liability to you for all claims in any 12-month period is limited to the fees you paid us in that period, or R1,000 if you paid nothing.
  • These limits do not apply to liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
  • Customers are responsible for their own conduct towards End Users and for compliance with the laws that apply to their business.

15Indemnity

Customers agree to defend and indemnify Olvix against claims, losses and costs (including reasonable legal fees) arising from their breach of these terms, their messaging practices, the content they publish, or their dealings with End Users.

16Suspension and termination

  • You can cancel a monthly plan at any time from the Service; it ends at the close of the current billing period and no further fees are charged.
  • We may suspend or terminate access immediately if you materially breach these terms, if your use creates legal or security risk, or if a channel provider requires it. Where practical we will warn you first and give you a chance to fix the problem.
  • On termination your right to use the Service ends. You can export your data before the account closes; we retain it only as described in the Privacy Policy.
  • Sections that by their nature should survive (including data, intellectual property, liability, indemnity and governing law) continue after termination.

17Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. If a dispute arises, contact us first and we will try to resolve it with you in good faith within 30 days. Failing that, the courts of South Africa have jurisdiction, without prejudice to your right to approach a consumer body such as the National Consumer Commission where the law provides for it.

18General

  • These terms, your plan and the Privacy Policy are the whole agreement between us and replace any earlier discussions.
  • If part of these terms is unenforceable, the rest still applies.
  • If we do not enforce a right immediately, we have not waived it.
  • You may not assign these terms without our consent. We may assign them to a successor of our business, and will tell you if we do.
  • Notices to us go to hello@olvix.co.za. Notices to you go to the email address on your account.
  • Neither of us is liable for delay or failure caused by events beyond reasonable control, such as network outages, provider failures or force majeure, except for payment obligations.
